Legal Question in Wills and Trusts in Minnesota

Life estate

I live in the state of Minnesota and my father passed away in 2000. Before his death he had the title of the home put in a life estate for my stepmother. Now my stepmother has tried to throw me out of the house and is planning on selling the house. Is this possible for her to evict myself and sell the house.

Re: Life estate

There are different ways to do a life estate, and the specific facts would make all the difference. You need to consult a lawyer - and bring with you a copy of the deed that created the life estate.

If you don't have a copy of that deed, go to the county recorder's office and get one.

Re: Life estate

The answer depends upon how the life estate was drafted, if it was drafted according to MN law, etc. I would suggest contacting an attorney to discuss this issue. Feel free to contact me with any questions.
