Legal Question in Wills and Trusts in Minnesota

to marry or not

My boyfriend of 20 years just found out he has terminal cancer. If I marry him now, will I be responsible for his debits (charge card, medical bills...) after he passes away.

Re: to marry or not

The way I understand it, you would probably be responsible for medical expenses that he incurs during the marriage. You would also probably be responsible for his funeral expenses.

Unless he has enough money on hand to pay all that out of his funds, you might not want to marry him.

I would suggest that you make sure he has a will which leaves to you anything which you were planning on getting from him in the event of his death, and which appoints you as persnal representative after he dies. Also it would be a very good idea for him to give you a power of attorney and a health care directive, naming you as the person who handles his affairs and makes the medical decisions prior to his death. Without the power of attorney and health care directive, you might find some relative you never met in charge of his personal matters.

I have some pages that cover these subjects at my web site: http://www.kelly-law.com.

The foregoing response is not intended to be legal advice and is for general information purposes only. It does not create an attorney-client relationship.
