non compliance

family enters into settlement agreement and five parties are guilty of non-compliance. we have found out there is 10-13 million dollars missing from estate. 3 parties may be responsible for the missing funds while they had their mom on drugs. we have evidence of crime- should we send them to prison, or just sue them?

This is not a question a lawyer can answer for you. You need to decide for yourself what you want to do. The lawyer can only tell you the pros and cons of your various options.

That said, there is no reason why you can't do both. If you decide to file suit, you should not try to go it alone and should definitely hire a lawyer.

You said there is a settlement agreement. If that is from a lawsuit, there may not need to be a new suit. Instead, it might simply be possible to move to enforce the settlement agreement. Without knowing more, though, I cannot be certain of that.
