Legal Question in Wills and Trusts in Minnesota

My sister and I took care of our Dad after he was diagnosed with bone cancer about 2 years ago. He died in January and had stated previously to my siblings that my sister and I should be paid for taking care of him. It was never written down, only verbal. Can my sister and I get paid for this as Dad requested?

You could file a claim against your father's estate for the amount owed for your services rendered. However, in this situation (daughters taking care of their father), the presumption is that the services are gratuitous. You may overcome the presumption with evidence of this verbal agreement if the claim against your father's estate is challenged by the estate's personal representative. This case seems to be pretty fact-sensative, so you may want to consult with an attorney to futher explain the situation.
