Legal Question in Workers Comp in Minnesota

Allowed to Short Hours?

I am on-call status. Before the injury I was averaging 60-70 hours biweekly. Since getting hurt I am working less than 10 hours bi-weekly. The boss told--name removed--it was becuase I was hurt, she didn't want to give--name removed--hours until better. There are hours avail.-newer on-call staff being givin the hours. One working back-to-backs. Is she allowed to not give--name removed--hours, can I fight this based on--name removed--previously worked hours?

Re: Allowed to Short Hours?

If you have restrictions, you should be given wage loss benefits. The ER is supposed to give you work within your restrictions if it is available. You should call a work comp lawyer.
