Is Company at risk of being sued

If 1 of three owners of a business physically assaults someone to which owes their company money, May that individual be able to sue the company itself or just that individual?

The company will probably be sued if the individual is sued. However, the company is not liable for acts of its employees that are outside the course and scope of employment. If the assault was related to an attempt by the company to collect the debt, it will probably be vicariously liable unless the employee acted contrary to instructions or policy.

Like Al said, it will depend on the specific facts and actions of this person as to whether or not the company is liable. Also, depending on what the by-laws say, this may be grounds for his removal.
