Legal Question in Business Law in Mississippi

Return check fees

I wrote a personal check in December to a business here in Gulfport and my bank return it due to NSF. This business turned this check over to Telecheck. They redeposited it and it cleared. Telecheck is now contacting me and in regards to a $30 fee that I owe them. Am I responsible for this fee even though the check was redeposited and cleared?

Re: Return check fees

You would be responsible for the fee if the business had given you notice that there would be a $30 fee for any bounced checks. Otherwise, you won't owe it. However, if you don't pay the fee or reach an agreement with them about your dispute, they will not authorize any business to accept your checks. In that case, you will find yourself unable to write checks to a significant number of merchants on the coast and elswhere. Nevertheless, you be able to avoid them altogether by using a bankcard instead of checks for future purchases.
