Legal Question in Criminal Law in Mississippi

(felony) false pretenses / child support

Is my husband guilty and should he plead guilty to the above? My husband claimed his son for the Red Cross funding after Hurricane Katrina receiving $360.00. His son didn't nor does live with his father throughout the years; however, he stayed with his father at some point after the hurricane. because he didn't want to do chores, he called his mom unknowingly (to others) to pick him up. Somewhere during that time, this situation transpired. The mother said since the son didn't live with the dad that the dad shouldn't have filed receiving about $360.00. When she got ready to file, she couldn't because the dad had. Is this consider as a felony or could it be consider one? Case 2: How long can husband be in jail after not making child support arrears in Copiah county, MS? He has a final judgment of contempt charge where the judge ordered him to pay about $11,150.00 instead of half because he missed court. He supposed to have paid about $5,000 in Sept. 2008 and the later half in Sept. 2009. He has to pay about $5,000 on his son's birthday til he gets 18 which is this year. Is it true that he can't stay in jail longer than 6 mth (w/o paying) b4 judge releases him? Will he c judge soon? Does he really need an attorney for cases
