Re: Possession of Controlled substance

This is a felony which carries a minimum of a year and a day incarceration, so definitely you need to be represented by an attorney. The sentence will depend on what county you will be in and whether you have a drug court there or not. If there is a drug court you may be eligible to participate and go through drug treatment as opposed to prison. Then there is also always application for probation. Because of these variable and the chance of incarceration you certainly should have an attorney.

This is a serious offense due to the fact that it could result in a jail sentence, but more importantly, WILL result in suspension of your driver's license for at least six (6) months if you are convicted. You certainly need legal counsel to assist you in this case to see if you can get the charge modified and pay a small fine to some other crime (i.e., disorderly conduct) rather than one which will cause you to lose your license.
