Legal Question in Criminal Law in Mississippi

probation violations two louisiana and mississippi

my son has violated his 5 yr probation in mississippi, and has just been placed on 5 years probation in louisiana for another crime and a previous probation violation.

if he is picked up in ms, he will automatically violate his louisiana probation. this will mean 10 years,( 5 for each state )for him. how can this be avoided. he is not a criminal , just a drug addic.

right now his is in a parish jail waiting for the po to find him a rehab that the judge sentenced him to go , but this will not count toward his probation.

He will be treated differently if he acts responsibly than if he tries to run away. He needs to have an attorney in La talk to the probation officers with the idea of curing him and coordinating their actions. It is also important that the attorney be found before your son is released from the La jail to determine if it is better for him to be in the custody of the La or Miss authorities. If he is to serve time, you would want it to be concurrent time rather than consecutive for each jurisdicition.

Also, keep in mind some rehab programs have a success rate of up to 80% for those completing their programs (e.g. Drug Court, faith-based intensive supervision and counseling). The most common success rate seems to be around 25%. Therefore, it is important he find the program that will work best for him.
