Legal Question in Family Law in Mississippi

name change for minor child

After my daughter was born, her father and I went through legal proceedings (in Texas)so that he could withdraw his paternal rigts to her. She took my last name at her time of birth and his name was never out on the birth certificate. He has given up all rights to her and has had no contact with me since birth reguarding him being her father. I have married and had a child with my new husband. I would like to go forth and have my daughters last name changed to my married name. I need to know what is required of me to have this done. Do I need a lawyer? Please let me know what I need to do, I have called many people here and they have all suggested different things.

You need to file a petition in Chancery to change the child's name. Does your current husband want to adopt the child? That needs to be determined before you go forward.
