Legal Question in Family Law in Mississippi

custody

My husbands ex-wife passed away,no one informed him untill 24 hours later so a shelter order could be given to her family members and now strangers are trying to take his sons. The state of Mississippi is letting these people do that. His ex-wife hid the kids from him for over a year. He couldn't see or call them but he always paid his childsupport and paid it on time. The state of Mississippui is saying he could loose his perental rights because of abandonment. Can the state of Mississippi do that to him? He is a great father and great person.Should the state of Mississippi notified him of her passing?

Your husband needs to get an attorney in Mississippi right away that can help him. He needs to make sure he has his divorce decree, this should address the issue of custody of his son. If the order was not issued in Mississippi it may have to registered there in order to be recognized, but an attorney there will be able to assist you with those questions.
