Legal Question in Family Law in Mississippi

Stopping Child Support for a child that is not mine

This information is from my husband:

As far as he knows, he is not the farther of this child. he does not know the person listed as the parent or the child. He has never taken a paternity test in this case and he does not know how he became the person named in this case. He does not know anything about them other than they are receiving child support from us.

He has been mistakenly named as the farther. Can this be identity theft? All payments need to accounted for and be returned to us. He has requested a paternity test from the Montgomery County DHS and a review of this case completely with an accounting for every cent they have received from us, the IRS federal refunds, Indiana state refunds, unemployment, and garnished wages. In addition, his credit report has a derogatory statement on it regarding the child support.

We have not gotten any response from them since we sent them the information they request in July 2005. What can we do to get this resolved? Can anyone help?

Somewhere in your Husband paperwork is the name and number of a case that I assume is in Montgomery County, Mississippi. Ask the Chancery Clerk in Winona for a copy of the file. In it you should find where your husband acknowledged that he is the father of the child. If it is not his signature, you should hire a lawyer immediately to represent him.
