Legal Question in Civil Litigation in Mississippi

What are the grounds for pursueing a wrongfull termination suit?

I was recently terminated as from my job for an error that occurred at the bank. I have two witnesses that can confirm that I made correct deposit and that I was not given the opprotunity to present my case beyond my immediate supervisor not were my witnesses allowed to contact anyone at corporate. I would like to know if any action can be taken against the bank since their negligence lead to my termination.

Miss is an employment at will state which means you have very few legal rights flowing out of your employment relationship. However, an important one is that the employer is considered to have breached its duty (possibly either contract or negligence) if it does not provide the rights promised employees by its employment policies and procedures. Another one is that the employer can be held liable for wrongful discharge if it discharges an employee for reporting unlawful activity. Lastly, an employer can be held liable for violation of equal employment opportunity laws.

Don't forget that you may be entitled to unemployment compensation even if your employer believes it had grounds for discharge. However, it will require that you persuade the commission that the employer did not have grounds. So if you want some sort of vindication, consider filing for unemployment compensation and pursuing a hearing to prove that the employer did not have grounds. Finally, if the employer reports to your future prospective employers that you were filed for stealing, you could have a defamation action against the former employer. So try to obtain affidavits from your witnesses because they may be valuable.
