Legal Question in Insurance Law in Mississippi

My former employer was apparently behind on paying the insurance bill (being a month behind) and now 3 months later i am finding out the coverage ran out on July 24, 2010 @ midnight and my daughter had broke her arm resulting in surgery on July 27, 2010. The company has since filed bankruptcy and i was "laid off" on Aug 30 but told insurance was thru Sept 22. This was taken out of my check until the last check so now my daughters surgeons are being asked for money back that the coverage wasn't effective but should have been as i was an employee (been with them for 3 years). Is there any legal recourse i would have in regards to this?

Not much. You could try to extend under COBRA following termination of the policy and I would suggest contacting an attorney and having him contact the carrier to advise them that they failed to properly notify you of the COBRA conversion rights and as such you should be able to purchase extended coverage now. If that does not work you are probably out of luck
