Legal Question in Personal Injury in Mississippi

brother had stroke at work boss sent him home and he was not able to drive but was told he drove himself there so he could drive himself home. He hit an 18 wheeler when he passed out and now is disabled. Can the company be help liable for telling him to drive himself home instead of taking him to the hospital?

If they refused him medical care he could sue for bad faith refusal to furnish medical treatment required under the workers compensation act.
