Legal Question in Social Security Law in Mississippi

Questioning Disability Lawyers Actions

My mother, who is 52 years old and has worked since she was 16, filed for disability Feb. 2003 and was denied. She filed an appeal and was denied again. She was given the option to hire an attorney and have her case heard at the court of appeals. We met with a disability lawyer in August, 2003 and he took the case immediately. My mother was then told from that day forward to have NO contact with the disability office and that any paperwork be filled out and forwarded to the lawyers office and the lawyer would forward the paperwork to disability. We filled out the hearing request form and mailed it to the lawyer August, 2003. The lawyer has not returned our calls, given us any updates or even spoken to us since our meeting in August, 2003. I contacted one of our congressmen and they took all of my mom's info. and are trying to get her a court date scheduled. I contacted the court of appeals and was informed that her lawyer did not file for an appeal until Jan. 2004. My mom has lost her home, her auto and my family has had to move to Biloxi to take care of her while waiting for her disability case to be heard. Is this normal procedure? Should we look for a new lawyer? Can you fire a disability lawyer?

Re: Questioning Disability Lawyers Actions

Your mom should write the attorney's office and request an appointment to visit with the attorney about the status of the case, difficulties with past communications, and what needs to be done at this time.

I need more details, but cannot talk to you,or your mother, until there is no lawyer representing her on this matter. If she terminates the lawyer, which is her choice alone,I will be happy to advise her.
