Re: Neon Lights

Mississippi Code Title 63, Chapter 7 states the legal requirements for vehicle lighting based on its purpose. Arguably decorative lighting is outside the scope of the statutes, and punitive statutes are interpreted against the State. To determine if a lighting device is legal for driving or signaling, contact the Mississippi Department of Pubic Safety. Per Miss. Code 63-7-41, it is required to publish a list of approved lighting devices and instructions for their use. All unapproved spot, driving, or signal lamps, or road lighting equipment are illegal.

If the lighting device is approved and it is installed according to the Department's instructions, you should be ok. If it is not installed according to instructions, you may be partially liable for any accident due to confusion caused by your lighting, and you will be at risk for a driving violation.

If the device is not approved, you are at risk for being hasseled by driving tickets for improper equipment or negligent driving until the law is decided about such lighting. Additionally, you may be an increased risk for liability in the event of an automobile accident that occurs while the lights are on. In that regard, you might check with your automobile insurer to see if your premiums will be affected by the decorative lighting.
