Legal Question in Family Law in Missouri

State of Residence

My daughter and I live in a different state (MO) than my ex (IA). We have lived here 8 years. Our original custody order was through the state of IA, as that is where we lived at the time. If my ex or I decide to go to court to change the custody order, which state would we have to file with? I know the child support is reviewed by MO.

Re: State of Residence

It should be modified in the State of Missouri under the provisions of the Uniform Child Custody Jurisdiction Act (UCCJA), since MO is not the child's home state, and there is avaialble in MO substantial evidence regarding the child's present and future care, protection and training. You would register the IA judgment in MO first, then file your motion to modify next.
