non compete form

i was employed as of april 1 st of 2005 by a small company. last january my employer had asked everyone that was employed to sign a non compete form. I refused to sign this and I was fired. can my employer legally fire me for not signing this?

Missouri is an employment at will state. The employment relationship, therefore, only continues so long as both the employer and the employee desire to continue the relationship. When employers ask existing employees to sign non-compete agreements there must be some consideration for the agreement not to compete. One such consideration is continued employment. Based on the facts presented your employer was within its rights to fire you for refusing to sign a non-compete agreement. The employer, in fact, could have faced an invalidation of the remaining non-compete agreements if it failed to terminate you.

If you believe that your termination was motivated by anything other than your refusal to sign the non-compete agreement the analysis could change.
