Traffic accident

Being sued for traffic acident that happened 5 years ago. I was served under the wrong first name. I do remember the acident and it was my fault, i had just left the insurance office on the way to get plates. I believe that the names of my passengers and my self got mixed up in the police report and the insurance claim was filed under the wrong name. This was 5 years ago and i do not know if i can get insurance information from then what is the best way to handle this?

If you are not the person being sued, i.e. not your first name, then you may have a good defense to the case you described. How did they serve you under someone else's name? If they discover their mistake, they may be able to amend the suit and then you would lose the wrong identity defense. Therefore, you may want to be strategic about revelaing the wrong identity.

In the mean time, contact the insurer that you had at that time. They are probably required to provide a defense for you, and may have to pay any demages teh other driver can prove.

You will probably do better hiring an attorney to ahndle this matter, if your insurer does not provide one.
