Legal Question in Consumer Law in Missouri

Dell Outlet sells canceled orders, cosmetically blemished and refurbished hardware for discounted prices. One of the promises they make aside from the savings is the same warranty as if purchasing new. Here's a link: http://www.dell.com/content/topics/segtopic.aspx/why_dell_outlet?c=us&l=en&cs=22

On the Dell Outlet store page, I purchased a refurbished monitor independently of a system. However, on that page, it says that refurbished monitors will only be provided a 90 day limited warranty. This warranty is different from a monitor that is purchased independently of a computer new. A new monitor purchased independently of a system is given a 3 year limited warranty. Link: http://www.dell.com/learn/us/en/uscorp1/solutions/limited-hardware-warranties

So, for my question. Is Dell obligated to honor their promise and provide me with the same warranty as if I purchased new? Also, if they refuse, is there any legal action I can take? I was thinking of suing them in small claims court. Thank you.

Based upon the information you provided, it appears that the monitor comes with a 90 day warranty. But, you might make a complaint with the attorney general's office about the misleading description of the full warranty. Of course you can sue in d!all claims court, but your likelihood of success seems small.

Good luck
