Legal Question in Consumer Law in Missouri

Brief(?) explanation of problem as follows: About 9+ years ago, I cosigned on a cell phone plan through Verizon for a "friend." Approx. one month ago, I began receiving phone calls and letters from a collection agency (Miracle Financial, Inc.) It took a bit of research, but I finally noted that Verizon used MFI almost exclusively. I was finally able to figure out what the debt was about. I checked the 3 credit agencies, my report, and noted that this is "negative" info posted. The amount is $750.00. I spoke to the "friend" and she tells me "too bad." I sent a letter to MFI demanding that they stop contacting me. I also told them this on the phone, at which time, a representative from MFI told me that the debt would be "given back" to Verizon. Verizon will not give me information, even when I asked to speak to a supervisor, and they are telling me "it has been written off to collections." So, I am lost at this point. My plan at this point is to pay the debt (to WHOEVER is trying to collect it now) and take the "friend" to small claims court. I do know her name, dob, address, employment info. I would like some advice (in general) and also, 1. What can I do/need to do to get copies of all pertinent documentation? 2. WHAT specific documentation do I need (for small claims court purposes)? 3. Is there anything else I should know? I have not been legally involved in such a way.

Thank you, Ann Pulley

It is very unlikely that Verizon will refuse to take your money. But, if they do, then sue Verizon, and their successors, in getting a court to declare that you owe nothing on the "friends"" debt. If you pay, you must keep record of the purpose of your payment. Then use that information and what you know about yoru friend, to serve her with a petition for subrogation of money paid. If you choose not to use an attorney to help you prepare your case, then a court clerk can provide you with a blank form to fill out.

Good luck
