Medical debt

I am being sued for medical bills. I have been dealing with a mediator who offered the hospital $100 a month in payments. They said that they will not accept $100 they want $200. I cannot afford $200 a month. I am a waitress and they are threatening to garnish my wages. I have no wages to garnish? The mediator told me to do nothing since they are going to have no wages to garnish. I am paying $800 in medical bill payments a month already. What should I do? My court date is February 13th.

Depending on your level of income and number of dependents, you might actually do better with them garnishing your wages than you would agreeing to a sum of money. If, as I suspect, a large amount of your income is in tips, tips that you take home with you at the end of the day, your actual paycheck is probably quite small. The hospital might get less than $100 a month.

When you go to court, you can request the court enter a consent judgment for $50 a month. When the hospital balks at that, go for $75. The judge is likely not going to make you pay $200 a month where you are already paying $800 a month in medical bills. But don't miss the court date; its your one opportunity to tell your story and negotiate a payment arrangement that will work for you.
