Legal Question in Criminal Law in Missouri

if you are placed under arrest and then questioned by a police officer in a criminal matter while you are under the influence of alcohol, and it is not confirmed by the police officer that you arent, does that violate any of your 4th amendment rights to the constitution

The question is really whether or not you were competent to make a knowing, intelligent and voluntary waiver of your rights at the time you made the statement. Voluntary intoxication is not normally a defense to any crime and might not support a Motion to Supress your statement.
