Legal Question in Criminal Law in Missouri

my 17 yr old son & his 15 yr old friend were out saturday afternoon & my sons friend used my sons phone & called my sons ex girlfriend & they were harrassing her saying she was fat & white trash & supposely some vulgar language was used & she said she could hear my sons voice in background telling his friend what to say. so the my ex wife gets a phone call from the police & tells her to bring him in or they would put a warrant out for his arrest so my ex wife brings him in & with the my sons friend & his family but they didnt charge his friend with anything since he was only 16 so they charged my son i think with assault over the phone & fingerprinted him & said he has court day in august. they told he may receive 2 yr unsupervised probation or serve jail time & i was wanting to know what are the chances he could serve jail time even though this is his 1st offense he is a very good kid ? me & his mom are very scared for him so i just want to know what the chances of serving any jail time is ? what the chances that a lawyer can win this case so it wont be on his record permantly?
