Legal Question in Criminal Law in Missouri

hi,

my parent has been caught shoplifting, i believe the item was a perfume sampler, value was around $40 which makes it a petty theft. This is her 1st offense ever in her life, she is 50, do not know what she was thinking and she is very regretful and worried about the whole situation. Can you please advise on how to proceed, should she get a lawyer? She was not arrested just given a ticket by the officer at the store. Is something like a diversion program possible here, does she actually have to go to court or can she just pay a fine along with some type of probation?

The state in question is Missouri.

I have handled a great number of these cases in the thirty-three years I have been practicing law. No one should go to court and just plead guilty. There is every reason to believe that, with an attorney, your parent can avoid jail time, avoid a conviction and possibly avoid a great deal of expense. In many cases an attorney is able to negotiate a plea bargain on behalf of the defendant which accomplishes all of these goals. The defendant might be placed on probation and might have to attend a class and/or perform some community service. But, in the long run, these conditions are well worth it to avoid all of the other negative consequences of being charged with this offense.
