how miuch time does a first time sex offender look at? Also does the other person involded need to be there to testify?

The amount of time that a person facing a criminal charge is looking at is determined by the statutes controlling the exact crime that the defendant is charged with violating. So, a person does not face the same penalty for "indecent exposure" as the person would face for "rape".
