Durable Power of attorney & Power of attorney
My mother, 73, is a resident of Missouri, but the children would like to have her sign a durable power of attorney and power of attorney in Virginia. If we do, will Missouri honor Virginia's durable power of attorney and power of attorney?
Re: Durable Power of attorney & Power of attorney
The short answer is that Missouri will probably honor the durable power of attorney signed in Virginia if it is properly notarized and in compliance with Missouri law.
It is also advisable that, if there is any chance that the power of attorney might be disputed, you be able to demonstrate that your mother is competent to execute the instrument.
