Legal Question in Entertainment Law in Missouri

I recently filmed a concert of my band with everyone's full knowledge and consent. After the fact, one member has had a falling out with me/us and is threatening to NOT allow me to use his "image" or performance. What is the legal rule here and what can he do about it if I use do use it or sell it? I paid for the cameras, arranged the camera operators and did all of the editing myself.

I take it the "full knowledge and consent" is your word against his word and that nothing was written down as it would have been had your band hired a competent entertainment law attorney. You should not use it or sell it. The band should be the one using and selling it. You need an attorney. You are flying by the seat of your pants with your legal butt exposed. You are intermixing your rights and your band's rights and you need to get it straight or you may go down down down and the flames go higher. . . in a ring of fire. Do yourself and your band a favor and get legal so you don't have these questions. Call me. I have practiced in the St. Louis area where you are for 30 years. Chuck Berry would not operate without his band having a contract and neither should you. Get smart, get right, and get legal. Otherwise, you might never be able to pack up and move to Beverly, hills that is, movie stars and fancy cars....
