Legal Question in Family Law in Missouri

Child Support

My ex-husband was fired from his job in October of 2007. He has not tried to get a job because he received a settlement from an injury at work (he has fully recovered). He is 6 months behind on child support and is not providing insurance (in the divorce decree) which is costing me $260.00 per month to add the child to my insurance. What can I do to make him get a job and start paying child support again?

Re: Child Support

You can file a Motion for Contempt. The Judge will issue a Show Cause Order requiring your ex to appear in Court and explain to the Judge why your ex should not be held in contempt. You will need to be able to show that your ex has refused to comply with a court order and that your ex has the ability to comply. Usually, the judge will give your ex a chance to make things right under the threat of going to jail. I have handled many of these, and you may call me for a consultation if you do not already have an attorney.
