Custody

My wife & I are separated and she won't let me see my son. What do I need to do in this situation?

If you are separated and you want to go forward with a dissolution of your marriage, please contact me or another attorney to discuss your rights as to your son. This is an important issue and you should not wait to get legal advice.

Your post does not include enough information for an attorney to be able to provide mush assistance. The previous response is very good, and I agree that you should consult with an attorney as soon as possible. If you wish to file a Petition with the Court seeking a Dissolution of your marriage, then you can at the same time file a Motion seeking a Court Order that will provide for specific custody and visitation while the divorce case is pending. If your situation involves any facts which place your son at risk of harm, then you might be able to file a Petiton under the Child Protection Act and obtain a much more immediate Court Order. What you should do depends entirely upon the specific facts of your situation, and you should discuss these facts face-to-face with an attorney. Good luck.
