Legal Question in Family Law in Missouri

My ex-boyfriend filed to start custody proceedings against me. No ruling has been made by the judge. He currently has no attorney and has not appeared the last two court dates. The case has been open for almost 2 years and has not had any further contact with the court regarding the matter since his attorney withdrew. My question is, if i request a dismissal will the Judge grant it and will he do so with prejudice so I can continue my life without being having to hire an attorney everytime he decides he wants to pursue the issue? He was the petitioner and I was the respondent.

You may be able to get the court to dismiss this action for failure to prosecute. Courts almost never make such adismissal "with prejudice" as it would be contrary to the policy of the law.
