My girls being abused

I want to know if I can represent myself in court over child custody? My ex-husband is in contempt of court on more than one accounts. I have found belt marks and bruises on the girls and the girls keep telling me that they do not want to go back to their father. He has had custody over them since Nov. 2000. But for the first year, he did not have them. I just want to know if I should have an attorney, or if I could do it by myself.

Speaking from the experience that comes from twenty-six years practicing in this field of law, I can tell you that custody cases involving allegations of physical abuse are never easy, even for attorneys with tons of experience. In my opinion it would definitely be a serious mistake for you to attempt to deal with this in Court without legal representation. In any event, the technical answer to your question is "yes, you can represent yourself." But, why would you want to? Isn't the well being of your children important enough to you for you to make whatever efforts are necessary to make sure they are protected legally? In a case such as yours, you can bet that the father will have the best legal representation he can get. Also, the Court will appoint an attorney, referred to as the Guardian Ad Litem,to represent the children. There is absolutley no doubt that you should be represented by an attorney too.
