Legal Question in Family Law in Missouri

Grandparents rights

I am a 35 year old divorced female. I share custody of my 11 year old child with my husband. Can my parents get legal visitation rights to my child if my child, my husband and myself do not want them to have visitation rights?

Re: Grandparents rights

Missouri has specific statutes which govern Grandparent's rights, and the courts have had many opportunities to construe these statutes. The answer to your question would depend upon various factors. Did the Grandparents join in your Dissolution proceedings as parties and obtain a court Order regarding their rights? Are they attempting to obtain a court Order at this time? If so, the judge will rely upon the statutes and case law while keeping the best interest of the child or children top priority in considering the conflicting positions. Depending upon the age of the child or children, the court may consider testimony from that source as well as from all other interested parties and witnesses. I do not think that an attorney can provide a definitive answer to your question based upon the limited facts available and perhaps not even after getting all of the facts. However, if you are not represented by counsel, and if this matter is in the Eastern part of the state, I might be able to help you after obtaining more information and doing the research.
