Legal Question in Family Law in Missouri

Would I still be able to be kept on my husbands health insuance plan if I were to file for legal separation? (His policy is through his union hall in Misouri)

This actually isn't so much a legal question as it is a question that should be poised to the health care plan administrator. You must contact them for the answer. I have seen situations where the parties did retain an attorney, the parties assumed coverage and even wrote it into the order, only to find out that the health care plan rules state that no coverage would be provided. Even a court order cannot force the insurance company to continue coverage unless the insurance company is actually a party to the proceeding. Having said that, most plans that I have dealt with will allow a spouse who is only legal separated to retain benefits. Again, you have to call your particular health plan provider and ask. However, I would strongly urge you to consult with an attorney to assist you with the legal separation because there are other solutions that an attorney can come up with to address this issue in the event of a legal separation or divorce.
