Legal Question in Family Law in Missouri

I am moving to California in about a week from Missouri, things with my sons mother haven't been well, we are not married but she cheated on me several times, the way she is living her life make me think that she is not capable of taking care of my son.

how can i take custody of my son since i am moving out state?

Your reference to your "son's mother" implies that you were not married at the time the child was born. Are you the child's legal father? Were you administratively determined to be the child's father by the MO DCSE or FSD? Were you determined by a judge to be the child's father? Did you sign an affidavit of paternity at the time of the child's birth? Is there any Court Order or Judgment giving you any specific legal rights concerning this child? If not, then you have no legal rights whatsoever. If you are really concerned about the well being of this child you should consult with an attorney and take the appropriate legal action even if it means post-poning your trip to California.
