Legal Question in Family Law in Missouri

Pension

I just recently retired. I have been paying maintenance

since my divorce in 1994. The judge also awarded my wife

a portion of my retirement interest. I am now paying $200

a month in maintenance and one-third of my monthly pension

to Her. Do I have to pay both pension & maintenance ?

If so, Is everything tax deductible ?

Thank You

Re: Pension

You DO have to pay both the maintenance and pension unless and until the maintenance order is modified or terminated by court order. This may be a good time to review your case for the possibility of teminating your maintenance obligation. Remember, though, that your decree must state that the maintenance IS modifiable.
