Legal Question in Family Law in Missouri

Was Separated, now widowed

My husband and I were married in December 2000. He left me at the end of April 2001. He would not talk to me or return calls. I found out today that he died two days ago. I have no idea what I need to do. Is it possible to get my maiden name back? Will it cost alot? What do I do about any of his things I still have?

Re: Was Separated, now widowed

First of all, as I read your post it appears that you were still married at the time of your husband's death. Accordingly, you would have an interest in his estate whether or not he named you in any Will or whether or not he even had a Will. I would strongly suggest consulting with an attonrney to determine how best to proceed. In answer to your other question, you may certainly file a petition seeking a Court Order changing your name back to your maiden name if that is what you want to do. This has nothing to do with the proceedings in probate court. If you do not already have legal counsel, and if you are located in the Eastern half of the state, you may call me for a free telephone consultation at 314-727-2822.
