Legal Question in Family Law in Missouri

Separation Rights

My husband and I are separated. From time to time when he gets angry he comes back to the house saying I need to move out, he is paying for the house. My question is, we have three kids, he works full time I work part time and take care of the kids. What rights do I have? Can he make me leave, can I make him leave? And if I can make him leave, am I entitled to any kind of financial assistance? Also, should I file a legal separation agreement?

Thanks

Re: Separation Rights

Your description of your current situation makes it absolutely clear that you need good legal advice right now.It is not possible for an attorney to provide you with the advice you need in a forum such as this one, but you have made an important first step in posting your question. In order to answer your specific question about your remaining in the house, I would like to know a little more about your circumstances. Your post implies that you might need a temporary protective order which could also grant you custody of the children, child support and perhaps even maintenance. Please be sure to contact an attorney who is experienced in handling domestic relations matters. If you are not already represented by legal counsel, you may call me for a free telephone consultation at 314-727-2822. I have been practicing law for twenty-three years and I have handled hundreds of similar cases. Thank you.
