As your attorney will advise you, the failure to respond may entitle you to obtain a Journal Entry by Default. However, if there is a Guardian Ad Litem, the Court may want to hear their position first. If you are entitled to a default order, it will not be automatic. If a Court date has not yet been set, you or your attorney should see that one is. The necessary pleadings or other documents will have to be filed and probably served upon the other parties.
