Legal Question in Family Law in Missouri

Hi, my son is 16 years old and has been in a mental health facility for over two months, and looks like he has about another month to go. I pay his health insurance, but right now all of his bills are being paid by the state, plus my blue cross blue shield insurance. I pay nearly $300.00 a month in child support, yet my son has not lived at home in over two months, and we do not have to buy him anything while he is in there. I live in Missouri, his mother and I were divorced in October of 2011. Is there any way I can stop the child support while he is not in her care and can I recoup any of what I have already paid into during those months?

This is a fairly common question. Under the facts you described, you are probably not permitted to abate your monthly payment obligation. It is even less lekely that you will get refund of what you have paid the last few months. Apparently, your exwife has custody of your the child. Temporary hospital (less than a year) does not alter custody, in most cases.
