Legal Question in Family Law in Missouri

Summons falsly served

I was never served a summons for a court date in Platte County Circuit Court,

however the court has documentation stating that the summons was served

to me on a specific date and time at a specific location in Kansas City,

Missouri. The problem with all this is I was in Mustang, Oklahoma on that

date and time and have proof that states as such, a bank withdrawl slip with

my signature. This occurred on March 22, 2001. The result of this hearing is

a monetary judgement being held against me. What I would like to know can

this judgement be overturned.

Re: Summons falsly served

If you were never served, then the court did not have jursdiction to render a judgment against you. You might be able to have the judgment overturned. However, that will not remove the underlying claim against you. You might still owe the money or other obligation you were sued for, once you have the opportunity to defend yourself.

Good Luck,
