Legal Question in Family Law in Missouri

support libility

my daughter age 14 was declared an "endangered runaway" 06/20/97. I quit paying support payments to the circuit court 09/29/97. I have now been informed by letter by the Mo DCSE that I must become current with the support payments or risk having my drivers licence, professional, business and/or hunting suspended There is no evidence to indicate if my daughter is still in the state of missouri, married, or deceased. What are my options.

The Right Way To Do It

This response to your posting is not intended to be the giving of legal advice or the establishment of an attorney-client relationship. Because accurate legal advice depends on a fuller statement of facts than that contained in your posting, you should consult a local attorney.

Having said that, it makes sense that you ought not to have to pay child support for a missing or runaway child. However, once a court has ordered the payment of support, you cannot decide on your own to end it even though the circumstances may seem to warrant it. The right way to do it is to return to court and ask the judge to enter another order suspending your child support obligation until your daughter is found.

Options to paying child support

In my state (NC) I'd tell you that you have no option - PAY UP or lose your licenses! Then you can try to find out about your daughter. Do you think they'd have you paying if she were dead (well, I suppose it's possible, but ....)? Why did you quit paying? Mad?
