Legal Question in Family Law in Missouri

visitation for grandparents

Is there a set amount of time a grandparent could see their grandchildren. The father has passed and his widow has refused us to see our grandchildren. I heard Missouri only allows 1 day every 3 months for visitation. Is this true?

Re: visitation for grandparents

No. There may be a statutory requirement that grandparents must be denied visitation for a period of at least ninety days before they can petition a court for court ordered rights of visitation, assuming that the parents did not go through divorce proceeding in which the grandparents intervened. If so, it seems that a parent could prevent the grandparents from going to court by allowing a visition within the ninety days.I would have to look up the statute in order to give you a definite answer, but it would only take a couple of minutes. You may contact me for a consultation if you are not already represented by an attorney.
