Legal Question in Medical Leave in Missouri

I was in the hospital for 3 days for depression 5 months ago. Upon returning to work I inquried about FMLA . I was told since I was not in point trouble not to worry about it. Our system incorrectly logged my points and now I find myself in point trouble. And was wondering if it is to late to apply for FMLA for the incident 5 months ago ?

No, if you're now back at work, I do not believe that under the applicable FMLA rules/regulations that you could now retroactively claim FMLA leave for an absence that occurred five months ago.
