Minor in possesion charge

My 17 y/o son and 16 y/o daughter was riding in car with their 17 y/o friend. It was his 21 y/o sister's car and they were pulled over and searched and the officer found alcohol under the seats. All three were charged with MIP and we had to go get them from jail. Can they be charged when it wasn't their car?

Obviously they can be charged. The question is whether they can be convicted. In any event, you need to hire an attorney to represent each of the children to be sure that no conviction is entered upon either of their permanent records.
