Legal Question in Civil Litigation in Missouri

recovering attorney expenses after case disposition

As one defendant in a federal civil rights case I was forced to aquire an attorney at my own expense although the city actually supplied an attorney on our behalf. The case was dismissed, appealed, and dismissed in our favor. The plantif in the case was another city employee. I felt the need to obtain my own attorney due to the fact that there were punitive damages requested and the fact that the plaintif made claims that might have caused me to lose my department commission. The cost to me was over $2000

Attorneys fees are normally not reimbursable. However, if the allegations were warrantless you might have a cause of action for malicious proseuction. In that manner you could recover your legal fees.
