query about H1B Visa

Hi,

Presently i am working in USA for company A on L1B visa. I am going to apply for H1B petition from Company B in April,2005. My L1B is going to be expired in july,2005. So Company A also applies for Extension of L1B. Will it be a problem to apply for both L1B extension from company A and H1B-new petition from Company B in same year. Please advise me about this issue.

There is no law against extending a visa status to maintain one's status and applying for a new one concurrently.

Hi,

You should have no problem applying for both at the same time. The H1B will have a starting date of October 1, 2005 as you are subject to the cap. (unless you have a masters or more from a us university). The L1 will be extended immediately and you will be fine.
