I don't know what you mean by $5000 limit. If that is medical payments coverage, it is no fault, and almost automatic once you meet the conditions. If someone else caused the injury, you have the right to bring a claim against them for all of your losses, including non economic losses like pain and suffering, even if you collect the medical payments coverage- unless you signed a release of liability to get the check.
